FCC Starts Clock On Net Neutrality Repeal, Faces Lawsuits

"Federal Register publication of the FCC's net neutrality repeal does not mark the end of the fight for an open internet but just the beginning".

But net neutrality supporters still have a chance to turn things around. The lawsuit asked the federal Court of Appeals in Washington, D.C., to find the Restoring Internet Freedom order unlawful.

Democrats, along with two independents and Sen.

Democrats need 51 votes to win any proposal in the Republican-controlled Senate because Vice President Mike Pence can break any tie. In the House, Doyle has 143 Democratic co-sponsors for a measure.

The lawsuit is filed by the Attorneys General of New York, California, Connecticut, Delaware, Hawaii, Illinois, Iowa, Kentucky, Maine, Maryland, Massachusetts, Minnesota, Mississippi, New Mexico, New Jersey, North Carolina, Oregon, Pennsylvania, Rhode Island, Vermont, Virginia, Washington, and the District of Columbia. On Thursday, Mozilla re-filed its lawsuit.

FCC Chairman Ajit Pai, a former Verizon attorney appointed by President Donald Trump past year, completed his campaign to repeal the Obama-Era Open Internet Order in December after he and his fellow commissioners voted 3-2 in favor of tossing it. This may particularly be true in rural areas, where there is often little or no competition among Internet service providers. In theory, service providers could choose which companies succeed and fail. For instance, carriers will be able to make their own video services more appealing by exempting their own streams from consumers' data caps. It will have many competitors. "It might not be called Net neutrality, but (it will address) what role should government have in this powerful new medium of the Internet".

On the other side, technology firms including Google's parent company Alphabet Inc and Facebook have thrown their weight behind the congressional bid to reverse the net neutrality repeal. Without these rules, Internet service providers may force websites to pay fees for faster Internet speeds, while limiting consumers' ability to access the Internet content of their choice. "Whether it is litigation, state action, or some other mechanism that brings it about, I am sure that robust net neutrality protections will prevail with the American public".

It's a somewhat ironic development.

The Internet & Television Association, a cable-industry trade association, says that the FCC plan removes unnecessary regulation. NY attorney general is set to sue the FCC over the repeal of net neutrality, and many more states and advocacy groups will follow the same route. If legal challenges (like the one being conducted by the attorney general of New York) fail to halt the repeal, US citizens will have to wait until 2020 to vote out Trump and install a new president who will be favorable toward the return of net neutrality.
