Warranty-voiding language like Nintendo's and Sony's is illegal — FTC

There are two exceptions, but they are very narrow.

The only conditions a firm can apply to restrict warranties in this way are if they receive a waiver from the FTC or provide the specified parts or services for free.

The FTC is pushing back against six major six major companies that market and sell automobiles, cellular devices, and video gaming systems in the United States, informing them that the "warranty void if removed" stickers are illegal. The FTC outlined three examples where "questionable provisions" are in play.

Hyundai USA now insists "the use of Hyundai Genuine Parts is required to keep your Hyundai manufacturer's warranties and any extended warranties intact", while Nintendo sees no problem voiding otherwise valid warranties if some of its gaming devices are "used with products not sold or licensed by Nintendo".

The second point of contention is that some companies void warranties should a product be used with products not sold or licensed by a company.

With regard to the warranty stickers, companies often place labels over screws or other parts of hardware that inevitably end up broken if opening the device. I have a feeling that this one in particular is aimed at smartphone companies.




This could be a major win for consumers: more repairs and service locations would be allowed under warranty, and modders of game consoles may be able to indulge their hobby without trying to hide it from the manufacturer.

This warranty does not apply if this product. has had the warranty seal on the PS4 altered, defaced, or removed.

FTC staff has requested that each company review its promotional and warranty materials to ensure that such materials do not state or imply that warranty coverage is conditioned on the use of specific parts of services.

The companies have been given a 30-day notice to update their website and comply with the US federal law before the FTC takes furth action. Well, it turns out such demands and claims are illegal, and the FTC is taking action against such practices.
